Facebook gains access to much of plaintiff’s contested ESI

As others have reported (see, e.g., several good pieces on Wired’s Epicenter blog posted by Ryan Singel on August 6, August 10 and August 11, 2011 [post-publication note: see also Ryan's August 15 post]), Paul D. Ceglia’s claim that he is entitled to part ownership of Facebook, Inc. now involves allegations by Facebook that Mr. Ceglia is trying to deny defendants access to critically important ESI — including what Facebook characterizes as the “authentic contract” as well as information about certain storage devices — by designating the ESI as privileged and/or designating it as confidential under the protective order filed on July 13, 2011. Welcome to the ESI Ninja blog. You may be asking yourself, “Why ‘ESI Ninja?’” Good question.
- “ESI” — because I’m interested in digital data, which litigators (prompted by the December 2006 amendments to the Federal Rules of Civil Procedure) often refer to as “electronically stored information.”
- And “Ninja” — well, frankly, “dude” might have been a more natural choice, since I grew up in the Easy Rider era, when we called one another “dude” without meaning to refer to guys who vacationed at “dude ranches”. But ever since the Coen brothers’ The Big Lebowski, Jeff Bridges’ character has owned the title “dude”; and I saw an article last year in the Wall Street Journal about “ninja” replacing “guru” in the Silicon Valley tech biz, so . . . “ninja” it was.
